IMPORTANT NOTICE: IDPFlare is open-source software provided "AS IS" without warranty. You are solely responsible for your deployment, its security, compliance with applicable laws, and any damages arising from your use.

1. Acceptance of Terms

By accessing, downloading, deploying, or using IDPFlare software ("Software") or visiting our documentation website ("Site"), you ("User," "You," or "Your") agree to be bound by these Terms of Service ("Terms"). If You do not agree to these Terms, You must not use the Software or Site.

These Terms constitute a legally binding agreement between You and the IDPFlare Project ("We," "Us," or "Our").

2. License

IDPFlare is open-source software licensed under the MIT License. The complete license text is available in the LICENSE file in our repository.

Subject to compliance with these Terms and the MIT License, We grant You a non-exclusive, worldwide, royalty-free license to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Software.

We make no warranties or representations about:

  • The accuracy, reliability, or completeness of the Software
  • That the Software will meet Your requirements
  • That the Software will be uninterrupted, timely, secure, or error-free
  • The quality of any products, services, information, or other material obtained through the Software
  • That defects in the Software will be corrected

4. Limitation of Liability

IN NO EVENT SHALL THE AUTHORS, COPYRIGHT HOLDERS, OR CONTRIBUTORS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

THE FOREGOING LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

5. User Responsibilities

5.1 Deployment and Management

You acknowledge and agree that You are solely responsible for:

  • All aspects of deploying, configuring, and operating the Software
  • Securing Your deployment and infrastructure
  • Monitoring and maintaining Your deployment
  • Implementing appropriate security measures and controls
  • Regular security audits and penetration testing
  • Keeping the Software and dependencies updated
  • Backup and disaster recovery procedures
  • Access control and user management
  • Key management and credential security
  • Incident response and breach notification

5.2 Security Responsibility

YOU BEAR SOLE AND EXCLUSIVE RESPONSIBILITY FOR THE SECURITY OF YOUR DEPLOYMENT. This includes, without limitation:

  • Securing API keys, encryption keys, and credentials
  • Protecting against unauthorized access, data breaches, and security incidents
  • Implementing appropriate authentication and authorization mechanisms
  • Securing data in transit and at rest
  • Implementing rate limiting, DDoS protection, and abuse prevention
  • Monitoring for suspicious activity and security threats
  • Conducting security assessments and vulnerability testing
  • Responding to and remediating security incidents

5.3 Legal Compliance

YOU ARE SOLELY RESPONSIBLE FOR ENSURING YOUR USE OF THE SOFTWARE COMPLIES WITH ALL APPLICABLE LAWS, REGULATIONS, AND INDUSTRY STANDARDS. This includes, without limitation:

  • Data protection and privacy laws (GDPR, CCPA, etc.)
  • Identity and authentication regulations
  • Industry-specific compliance requirements (HIPAA, PCI-DSS, SOC 2, etc.)
  • Export control and sanctions laws
  • Accessibility requirements (WCAG, ADA, etc.)
  • Consumer protection laws
  • Intellectual property rights

5.4 User Data and Privacy

You acknowledge that:

  • You are the data controller for all user data processed by Your deployment
  • You must create and maintain Your own privacy policy
  • You must obtain all necessary consents from Your users
  • You must implement appropriate data retention and deletion policies
  • You must respond to data subject access requests and similar inquiries
  • You must report data breaches as required by applicable law

5.5 Third-Party Services

If You integrate third-party services (email providers, social login providers, etc.) with Your deployment:

  • You are responsible for compliance with their terms of service
  • You are responsible for securing API keys and credentials
  • You are responsible for any costs incurred
  • You are responsible for any data shared with these services

6. Indemnification

You agree to indemnify, defend, and hold harmless the IDPFlare Project, its contributors, maintainers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including attorney's fees) arising from:

  • Your use, deployment, or operation of the Software
  • Your violation of these Terms
  • Your violation of any third-party rights, including privacy rights or intellectual property rights
  • Your violation of any applicable laws or regulations
  • Security breaches or data breaches in Your deployment
  • Any claims by Your users or third parties
  • Your negligence or willful misconduct

7. No Support or Maintenance

We are under no obligation to provide support, maintenance, updates, enhancements, or modifications to the Software. Any such support, if provided, is entirely at Our discretion and may be discontinued at any time without notice.

Community support may be available through GitHub issues, but We make no guarantees regarding response times, resolution, or availability of support.

8. Updates and Modifications

We may release updates, patches, or new versions of the Software from time to time. You are responsible for:

  • Monitoring for updates and security patches
  • Testing updates before deploying to production
  • Implementing updates in a timely manner
  • Ensuring compatibility with Your infrastructure

Updates are provided "AS IS" without warranty. We are not liable for any issues arising from updates or Your failure to apply updates.

9. Acceptable Use

You agree not to use the Software:

  • In any way that violates applicable laws or regulations
  • For any unlawful, fraudulent, or malicious purpose
  • To transmit or store illegal content
  • To impersonate any person or entity
  • To infringe upon intellectual property rights
  • In any way that could damage, disable, or impair Our reputation

10. Intellectual Property

Subject to the MIT License, We retain all rights, title, and interest in the Software, including all intellectual property rights. You may not:

  • Remove or modify any copyright, trademark, or proprietary notices
  • Use Our trademarks or service marks without permission
  • Claim ownership of the Software

Contributions to the Software are subject to the terms in our CONTRIBUTING file, if any.

11. Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically without notice if You fail to comply with any provision.

Upon termination:

  • You must cease all use of the Software
  • You must delete all copies of the Software in Your possession
  • Sections 3-6, 8-9, and 12-18 shall survive termination

12. Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

  • THE SOFTWARE MAY CONTAIN BUGS, ERRORS, OR VULNERABILITIES
  • WE DO NOT GUARANTEE THE SOFTWARE IS SECURE OR FREE FROM DEFECTS
  • THE SOFTWARE HAS NOT BEEN AUDITED FOR SECURITY
  • USE OF THE SOFTWARE IS AT YOUR SOLE RISK
  • YOU ARE RESPONSIBLE FOR CONDUCTING YOUR OWN SECURITY AUDITS
  • WE MAKE NO REPRESENTATIONS REGARDING REGULATORY COMPLIANCE

13. Third-Party Dependencies

The Software may include or depend on third-party libraries, frameworks, and services. You are responsible for:

  • Reviewing and complying with third-party licenses
  • Understanding security implications of dependencies
  • Monitoring for vulnerabilities in dependencies
  • Updating dependencies as needed

We are not responsible for any issues arising from third-party dependencies.

14. Export Compliance

The Software may be subject to export control laws and regulations. You are responsible for compliance with all applicable export laws and shall not export, re-export, or transfer the Software in violation of such laws.

15. Governing Law and Jurisdiction
